  2. Scope
This policy applies to the website and online shop at landroverswamp.com, including all pages, checkout, and related customer service communications.

  3. What we process and why (overview)
We process personal data to operate the shop, provide products and services, communicate with you, secure the site, comply with legal duties, and improve performance and customer experience.

Depending on your use of the shop, this can include:
• Identifiers and contact details (name, email, phone)
• Order and contract data (items, quantities, prices, invoices, delivery details)
• Payment-related data (transaction references; details depend on the payment method)
• Device and usage data (IP address, timestamps, pages viewed, browser/device information, referrer)
• Customer support messages and preferences

  1. Legal bases (GDPR)
We process data under the GDPR on the following bases:
    • Contract performance and pre-contract steps: Art. 6(1)(b) GDPR
    • Legal obligations (e.g., tax and commercial law): Art. 6(1)(c) GDPR
    • Legitimate interests (operation, security, fraud prevention, service improvement): Art. 6(1)(f) GDPR
    • Consent for optional cookies/marketing/analytics where required: Art. 6(1)(a) GDPR
For cookies and similar technologies on end devices, German law applies in addition (see section 10).

  2. Shop platform and hosting (Shopify)
Our online shop is provided via Shopify. Shopify processes personal data as a service provider for hosting, checkout, store functionality, and security. Depending on configuration, Shopify also provides analytics and reports for store operators.

  3. Server log data and security
When you visit the site, technical access data is processed (e.g., IP address, date/time, requested page, browser/device data). This supports delivery of the website, stability, security monitoring, and troubleshooting.
    Legal basis: Art. 6(1)(f) GDPR.

  4. Orders, checkout, and contract handling
When you place an order (or start checkout), we process the data needed to set up and fulfil the purchase contract: customer details, billing/shipping address, ordered products, contract communication, and status information.
Legal basis: Art. 6(1)(b) GDPR; retention under Art. 6(1)(c) GDPR for statutory duties.

  5. Payments
For payment processing, necessary data is shared with the selected payment provider (and, depending on setup, via Shopify’s payment services). The exact data fields depend on the chosen payment method.
    Legal basis: Art. 6(1)(b) GDPR.

  6. Shipping and delivery
To deliver orders, we share required delivery data with shipping and logistics providers (typically name, address, and where supported: email/phone for delivery notifications).
    Legal basis: Art. 6(1)(b) GDPR.

  7. Cookies and similar technologies (end devices)
The shop uses technologies such as cookies, local storage, and similar identifiers.

a) Essential technologies
Some technologies support core functions such as cart, checkout, security, language settings, and fraud prevention.
Legal basis: Art. 6(1)(b) GDPR (service requested) and/or Art. 6(1)(f) GDPR (operation and security), together with the applicable German rule for “strictly necessary” storage/access on end devices.

b) Optional analytics and marketing technologies
Where we use analytics, personalization, or marketing tools that store or access information on your device beyond what is essential, we rely on your consent via the consent banner / cookie settings.
Legal basis: Art. 6(1)(a) GDPR, together with the applicable German rule for consent-based storage/access on end devices.

You can adjust your cookie settings at any time via the cookie settings link on the website (where provided).

  1. Analytics, performance measurement, and marketing (depending on configuration)
Shopify can provide store statistics and reports (for example: traffic sources, conversion performance, and sales metrics). If additional tools are enabled (e.g., pixels, advanced analytics, email marketing apps), processing occurs according to the tool’s function and your consent settings where required.
Legal basis: consent (Art. 6(1)(a) GDPR) for consent-based tracking; otherwise Art. 6(1)(f) GDPR for aggregated performance evaluation and service improvement.

  2. Recipients and processors
We share data only where it supports the purposes above, typically with:
    • Shopify (shop platform, hosting, checkout)
    • Payment providers (payment processing)
    • Shipping/logistics providers (delivery)
    • IT and security service providers (site operation and protection)
    • Professional advisors where relevant (e.g., tax, legal)
    • Public authorities where required by law

  3. International data transfers
Shopify’s infrastructure and corporate structure can involve processing outside the EU/EEA. For transfers, Shopify describes safeguards such as adequacy decisions (e.g., Canada where applicable) and Standard Contractual Clauses (SCCs) for other transfers, depending on the transfer path and services used.

  4. Retention periods
We store personal data as long as needed for the purposes described. Contract and billing records are stored according to statutory retention periods under German commercial and tax law. After expiry, data is deleted or restricted in line with legal requirements and operational needs.

  5. Your rights
Under the GDPR, you have rights including: access, rectification, erasure, restriction of processing, data portability, and objection to processing based on Art. 6(1)(f) GDPR.
Where processing is based on consent, you can withdraw consent at any time with effect for the future (for example via cookie settings or by contacting us).

  6. Supervisory authority (complaints)
You can contact a data protection supervisory authority. For Lower Saxony (Niedersachsen), the competent authority is:
The State Commissioner for Data Protection Lower Saxony (LfD Niedersachsen)
    Prinzenstraße 5, 30159 Hannover, Germany
    Email: poststelle@lfd.niedersachsen.de
    Phone: +49 511 120-4500

  7. Updates to this policy
We update this policy when processes, tools, or legal requirements evolve.
